Protecting the weak party in international private relations In light of the Corona pandemic

Abstract

The research deals with an important issue of the newly created legal issues, namely (protection of the weak party in international private relations in light of the Corona pandemic) as one of the important issues related to public order in light of the occurrence of exceptional circumstances represented by the Corona pandemic. This results in a defect in the legal centers regarding Contracts. The matter becomes more complicated if we are in front of a contract of an international nature. It makes the implementation of the obligations contained in it a burdensome at times for one of the contracting parties to the extent that it is difficult for him to implement them, or makes them impossible to implement at other times. In both cases, failure to implement becomes a burdensome for the rights of one of the contracting parties, which leads to an imbalance in the legal positions. As a result, the solutions established by internal legislation and international agreements on international trade to protect the weak party in contractual relations due to sudden events that change their implementation and generate terror for the parties to these contracts to secure the life of the contract.
