The responsibility for international protection of human rights in the wars of the twenty-first century

Abstract

This research explores the principle of the "Responsibility to Protect" (R2P) as a modern development in international law aimed at safeguarding human rights from grave violations, particularly in the context of armed conflicts and the wars of the 21st century. The study highlights the apparent tension between R2P and the traditional principle of state sovereignty and non-intervention, which raises legal and political challenges to its effective implementation. It also examines the main obstacles hindering the application of R2P, including the lack of political will, the selective application of the principle, and the weakness of international intervention mechanisms. On the other hand, the research identifies legal and political opportunities that, if properly utilized, could strengthen the implementation of R2P and contribute to reducing genocide and large-scale human rights abuses. The study concludes that the success of this principle depends on genuine international will and the development of clearer legal mechanisms that balance the protection of sovereignty with the imperative of safeguarding human rights.
