Abstract

Administrative judiciary is one of the fundamental tools in the protection of human rights, as it contributes to ensuring respect for the fundamental rights and freedoms of individuals in the face of administrative authorities that may act arbitrarily against them. The protection of digital rights within the framework of administrative judiciary requires an independent judicial system capable of confronting administrative power and safeguarding individuals from abuse or discrimination. With technological advancement, the scope of human rights has expanded to include digital rights alongside the traditionally recognized fundamental rights. As governments and administrative authorities increasingly utilize technology in the management of public affairs, significant challenges have emerged concerning administrative overreach that may infringe upon these rights. This research aims to examine the role of the administrative judiciary in protecting individuals' digital rights, based on the judicial rulings issued by the Iraqi administrative judiciary.
